Client Ghosted After Paying the Deposit? Here’s How to Enforce the Rest—Legally
You landed the deal. You got the deposit. Then—radio silence. When a client ghosts after a partial payment, you may still be entitled to recover the full amount legally. Here’s how.
1. Check Your Contract
Look for:
- Non-refundable deposit clauses
- “Time is of the essence” provisions
- Attorney’s fees if you have to sue
2. Send a Legal Demand
A firm, well-drafted demand letter builds pressure—and a legal record. This alone may recover what you're owed.
3. Consider Small Claims or Court
Depending on the amount, small claims or commercial litigation may be appropriate. Don’t delay—legal rights have time limits.
4. Preserve Communications
Save emails, texts, and your invoice. Ghosting isn’t a defense—it’s documentation fuel.
5. Move Quickly
New York and New Jersey law favor timely action. If you wait, your rights may expire—or get harder to enforce.
